HomeVestors Shuts Down More Than 100 Trademark Infringers in 2016

Company Enters New Year with Growing Reputation for Aggressive Trademark Enforcement

January 30, 2017 // Franchising.com // DALLAS - HomeVestors, the company known for a variety of registered trademarks, including We Buy Ugly Houses®, continues to utilize assertive action to defend its well-established national identity and honest reputation against trademark infringements.

Since their incorporation in 1996, HomeVestors has owned and used the HomeVestors®, We Buy Ugly Houses® and the “ugly” family of marks, and other proprietary trademarks continuously for many years. Although franchisees are licensed to use these trademarks in connection with their business, unauthorized use by third parties is strictly prohibited. As the number one home buyer in the country and the first and only franchise in the residential real estate investment industry, it is crucial for HomeVestors to protect its national brand. The company is committed to upholding the value of its franchisees’ advertising dollars by policing the theft of customer leads by competitors who unlawfully use HomeVestors’ trademarks.

“We’ve always instilled the importance of honesty in our company. Our legal team has done an outstanding job of upholding that and our hard-earned credibility,” said HomeVestors Co-President Ken Channell. “When people hear about us, we want them to think of a nationally recognized, well-established, trustworthy operation that looks out for its franchisees and their customers.”

2016 was a banner year for HomeVestors’ trademark enforcement efforts. HomeVestors’ legal team initiated two dozen trademark infringement lawsuits in 2016. Defendants in the lawsuits are in 12 states, including Arizona, California, Florida, Colorado and Texas. Additionally, in 2016, HomeVestors was also successful in eradicating 117 instances of trademark infringement on outdoor advertising and competitors’ websites without litigation, and 283 infringing social media posts and online advertisements were taken down or cleansed of their HomeVestors trademarks.

“We want to make it clear that we do not tolerate anyone trying to tarnish our name and our integrity or take advantage of our success,” said HomeVestors co-president, David Hicks. “When the competition uses our trademarks, they are effectively stealing our advertising. Our trademark enforcement efforts benefit our independently owned and operated franchises by enhancing the value of their advertising spend.”
