Remember pulling up to the Jack in the Box drive-thru in the 1970s and placing your order through an over-sized talking Jack head where the voice on the other end sounded like a grown up from a Charlie Brown cartoon. You had no idea what the person on the other end was saying or how your order would turn out. Times have changed and the evolution of technology in the fast food industry is picking up the pace - and making the fast food arena one full of strong franchise opportunities.

If you're reading this, you already know that franchising is a different business model. That it involves paying the franchisor an initial franchise fee, as well as ongoing royalties and, often, paying into an advertising fund. And that you're willing to pay those costs for the privilege of using a recognized brand name and an operating system with a successful track record. Not to mention the initial and ongoing training and support the brand offers.

Business Opportunity!! The words practically leap from the pages--whether in well-known national business publications such as the Wall Street Journal or Entrepreneur magazine, or in the classifieds flooding the back of the smallest daily and weekly newspapers in every city and town in the world. But what exactly is a business opportunity?

Outsourcing has become an accepted method for companies to solve staffing needs. It's a strategy that allows firms to benefit from specific expertise--without the accompanying expense. Mostly, it's been applied to functions like HR, accounting, and payroll. Today, franchisors can outsource their franchise development.

Being an area developer, most outsiders would think, is a guaranteed stress-builder. After all, minding a number of businesses--let alone starting them up--has more problems in more directions than your average C-level exec faces every day.

If someone had told Heidi Morrissey 20 years ago that she'd wind up as heir apparent to the family business, Kitchen Tune-Up, she would have probably rolled her eyes in that way that only a teenager can. And if her four siblings had dared to suggest that she, of them all, was most like their master-salesman father, she'd have repeated the eye roll and added an indignant snort.

Unfortunately for those who take on the job of growing a franchise business, financial risk is always present. If you are like other franchisors who want to minimize risk and boost profits, you may want to take a serious look at using a more extensive corporate-ownership program than you now have in place.

In my previous column, I discussed the first two pieces of how to build an organization that grows your franchise business. Part one was planning the structure of your organization over time, based on your territory, market, or development growth in terms of your team. Part two focused on the functional role of individuals within the organization. The third piece is how to develop pools of talent.

Successful franchise selling must employ 1) an effective and qualifying process; 2) strong relationship-building with candidates; and 3) a compelling system for closing the deal. These three triggers are universal within any franchise recruitment program.

Whether you are a franchisor or a multiunit franchisee, you must have noticed that the marketing and sales landscape is changing. No matter what kind of business you're in, status quo marketing and sellingis no longer going to get you the resultsyou need or want. In a business-to-consumer franchise system you will see the demographic changes in your customer marketplaces more quickly than in business-to-business. Time to wake up and smell the demographic coffee!

As the American waistline has continued to expand, more and more people are turning to fitness centers to help them lose weight. Statistics show that more than 60 percent of all Americans are overweight. A 2004 report by nonprofit research group RTI International and the Centers for Disease Control and Prevention estimates that obesity costs the United States as much as $75 billion in medical expenditures annually. "With the cost of health care being what it is, people want to make it a priority to take care of themselves," says Shirley Archer, an author, speaker, and health and wellness educator for the Health Improvement Program at Stanford University. Consequently, fitness-related franchises are rapidly growing to fill this niche.

For those of you who have been living under a rock for the past 10 years, I have a newsflash: Since 1995, The Federal Trade Commission has been involved in a rule- making process to amend the FTC Rule (the "Rule") to change certain disclosure requirements and to recognize certain changes to the franchise business sales model and use of technology in the franchise sales process. What we know is the likely substance of the changes; what we don't know is when they'll be implemented.

Australian companies looking to expand beyond their borders are casting a hungry eye on the U.S. market. Physically Australia is over ¾ the size of the United States but there are only 19.9 million people in the country compared to a population of over 293 million in the U.S. What's more, high household and disposable incomes and the almost competitive desire to be the first on their block to try something new give American consumers both the means and the propensity to buy Australian products and services.

Providing employment advice through franchisees can be a tricky business-and very expensive if not done correctly. Amounts awarded in damages for employment cases brought against employers are on the rise. Damages recovered against employers in litigation brought by the Equal Employment Opportunity Commission (EEOC) rose from $52.8 million in 2002 to $148.7 million in 2003. Damages received per case also increased from an average recovery of approximately $140,000 in 2002 to almost triple that amount-$390,000-in 2003.
